Vollständiger Abstract
Worum geht es in dieser Arbeit?
The phenomenon of globalization has intensified the role of international organizations in shaping national legal systems. In this context, the study aimed to analyze how international organizations influence the formation and evolution of Brazilian legislation, particularly in the context of international cooperation and the recovery of illicit assets, with the specific objectives of examining the main instruments or means of influence used by international organizations under Brazilian law—such as treaties, guidelines (soft law), and political and diplomatic pressure; to present the impacts of this influence on the Brazilian legal system, with an emphasis on areas such as human rights, the fight against corruption, and international trade. The methodology adopted is qualitative, based on a literature review and normative analysis of international instruments and their incorporation into Brazilian law. The research findings indicate that mechanisms such as treaties and soft law play an essential role in Brazilian legislative modernization, particularly in asset recovery and the fight against transnational crime; despite challenges to state autonomy, international cooperation strengthens the effectiveness of domestic law and promotes greater alignment with global requirements.
